Terms of Use

These Terms govern your use of the BOWSER mobile app. By downloading
or using the app, you agree to them. If you don't agree, please don't use the app.
1. The app
BOWSER helps you find fuel prices and plan trips in Australia. We grant you a
personal, non-exclusive, non-transferable, revocable licence to use the app for
your own non-commercial use, subject to these Terms and the app store's terms.
2. Fuel prices & data are indicative
Fuel prices, station locations, traffic, camera, weather, and forecast
information come from third-party and government sources and may be delayed,
incomplete, or inaccurate. Prices change frequently and may differ from what you
pay at the pump. Forecasts and "best day to fill" guidance are estimates, not
guarantees. Always confirm the actual price and conditions before
purchasing or relying on any information in the app. Use the app
responsibly and obey all road rules, and do not interact with the app while driving.
3. Savings claims
Any reference to potential savings (e.g. "$200 to $400 a year") is a general,
indicative figure based on published Australian averages (ABS vehicle-use data and
ACCC petrol price-cycle data), not a promise of the savings you will achieve. Your
actual savings depend on your driving, location, vehicle, fuel type, and prices at
the time. We do not guarantee any specific saving.
4. BOWSER+ subscription
- What it is. BOWSER+ is an optional auto-renewing
subscription that unlocks premium features (full price & cycle
analysis, cheapest-fuel-along-route planner, cycle-low alerts, full
garage) and removes ads. The core app remains free.
- Free trial. Eligible new subscribers may start with a free
trial. If you don't cancel before the trial ends, it automatically converts
to a paid subscription at the price shown in the app. Any unused portion of a
free trial is forfeited if you buy a subscription during the trial.
- Billing & auto-renewal. Payment is charged to your Apple
App Store or Google Play account at confirmation of purchase. The
subscription renews automatically for the same period at the then-current
price unless you cancel at least 24 hours before the end of the current
period. Your account is charged for renewal within 24 hours before the period
ends.
- Managing & cancelling. You can manage or cancel your
subscription anytime in your device's account settings (App Store or Google
Play). Cancelling stops future renewals; it does not retroactively refund the
current period.
- Prices. Current prices are shown in the app before you
purchase and may vary by region and over time. We may change subscription
prices; changes won't affect a period you've already paid for.
- Refunds. Purchases are handled by the app stores, so refunds
are subject to Apple's and Google's policies. We can't directly process
refunds for store purchases.
5. Ads
The free version displays advertising. See our
Privacy Policy for how advertising data is handled.
6. Acceptable use
You agree not to misuse the app, including reverse-engineering it (except as
permitted by law), scraping or bulk-extracting its data, interfering with its
operation, or using it for any unlawful purpose.
7. Intellectual property
The app, its name, branding, and content (excluding third-party data) are owned
by us or our licensors. These Terms don't transfer any ownership to you.
8. Your consumer rights
Nothing in these Terms excludes, restricts, or modifies any consumer guarantee,
right, or remedy you have under the Australian Consumer Law or other law that
cannot be lawfully excluded. Where our liability can be limited, it is limited to
re-supplying the app or the cost of doing so.
9. Disclaimers & liability
Except for rights that cannot be excluded (see section 8), the app is provided
"as is" and "as available" without warranties of any kind. To the extent permitted
by law, we are not liable for any indirect or consequential loss, or for any loss
arising from your reliance on fuel prices, forecasts, routes, or other information
in the app.
10. Changes & termination
We may update the app and these Terms from time to time; material changes are
shown by the "Last updated" date. We may suspend or stop providing the app. You may
stop using it at any time by deleting it.
11. Governing law
These Terms are governed by the laws of New South Wales, Australia, and you
submit to the non-exclusive jurisdiction of its courts.
12. Apple App Store
If you download BOWSER from the Apple App Store, the following additional
terms apply and, in the event of any conflict, prevail over the rest of these
Terms for that copy of the app:
- Between you and us. These Terms are between you and us
(the developer) only, and not with Apple. Apple is not responsible for
the app or its content. To the extent these Terms provide usage rules for
the app that are less restrictive than, or conflict with, the Apple Media
Services Terms and Conditions, the more restrictive or conflicting Apple
term applies.
- Scope of licence. The licence granted in section 1 is a
non-transferable licence to use the app on any Apple-branded device that
you own or control, as permitted by the Usage Rules in the Apple Media
Services Terms and Conditions, except that it may be accessed by other
accounts via Family Sharing or volume purchasing.
- Maintenance and support. We are solely responsible for
providing any maintenance and support for the app. Apple has no obligation
whatsoever to furnish any maintenance or support services for it.
- Warranty. We are solely responsible for any product
warranties, whether express or implied by law, to the extent not
effectively disclaimed. If the app fails to conform to any applicable
warranty, you may notify Apple, and Apple may refund the purchase price
(if any) of the app to you; to the maximum extent permitted by law, Apple
has no other warranty obligation whatsoever with respect to the app.
- Product claims. We, not Apple, are responsible for
addressing any claims by you or a third party relating to the app or your
use of it, including product liability claims, any claim that the app
fails to conform to any legal or regulatory requirement, and claims
arising under consumer protection, privacy or similar legislation.
- Intellectual property. If a third party claims the app or
your use of it infringes their intellectual property rights, we, not
Apple, are solely responsible for the investigation, defence, settlement
and discharge of that claim.
- Legal compliance. You represent and warrant that you are
not located in a country subject to a U.S. Government embargo, or
designated by the U.S. Government as a "terrorist supporting" country, and
that you are not listed on any U.S. Government list of prohibited or
restricted parties.
- Third-party terms. You must comply with any applicable
third-party terms of agreement when using the app (for example, your
wireless data service agreement).
- Third-party beneficiary. Apple and Apple's subsidiaries
are third-party beneficiaries of these Terms, and upon your acceptance of
these Terms Apple will have the right (and will be deemed to have accepted
the right) to enforce these Terms against you as a third-party beneficiary.
- Developer contact. Any questions, complaints or claims
about the app should be directed to us using the contact details in
section 13 below.
